Sales tax increase for natural resources and cultural programs

One of the first bills filed in 2007 -- S.F. 6 -- underscored the intent of legislators to resurrect a cantankerous issue fomr 2006: a sales tax dedicated to natural resources and cultural programs. In 2006, the addition of "cultural" programs drove a wedge between sportsmen and patrons of the arts.

House Taxes Committee approval
May 16, 2007 (HF2285)

The House Taxes Committee had tabled the bill after Rep. Dean Simpson (R-Perham) successfully amended the 2008 ballot question to include the sentence, "By voting yes on this question, you are voting for a tax increase." Committee members, however, later voted 11-10 to remove Simpson’s amendment, then approved the bill 12-10.

The bill passed on a 52-to-14 vote. Several amendments to reduce or eliminate dedication of funds to cultural programs failed. The closest amendment, however, may have been one by Sen. John Marty, who objected to the concept of using the constitution for the budget process. It was turned aside 28-to-38, however.

House State Government Finance Division approval

HF2285, sponsored by House Majority Leader Tony Sertich (DFL-Chisholm), would propose a constitutional amendment to raise the state sales tax by three-eighths of 1 percent and divvy up the additional revenue as follows:
• 25 percent for fish and wildlife habitat
• 25 percent for clean water
• 15 percent for parks and trails
• 15 percent for drinking water protection
• 10 percent for arts and cultural heritage and
• 10 percent for the Legislature to appropriate at its discretion for the purposes listed above.

Result: Passed

Senate Taxes Committee approval of reworked bill
May 9, 2007 (SF6)

Sen. John Marty (DFL-Roseville) offered an amendment to change the bill to a statutory dedication instead of a constitutional dedication. Sen. Keith Langseth (DFL-Glyndon) said the state shouldn't change the constitution unless there is good reason. Langseth said the purposes in the bill do need funding, but it should be done through statute. Sen. Julianne Ortman said a statutory dedication will turn into another slush fund and the Legislature cannot guarantee the money will go for these purposes. Bakk said a statutory dedication is law and it is not fair to characterize it as spending any way the Legislature wants. By changing the bill to a statutory dedication, members are putting together a bill that can get the votes it needs on the Senate floor. The amendment was adopted. The bill, as amended, was recommended to pass and re-referred to the Senate floor.

Senate Taxes Committee defeats bill
April 24, 2007 (SF6)

The bill came up two votes short of the needed majority in the Senate Taxes Committee, dimming the measure's prospects this year. The Legislature is debating whether to put it on the 2008 ballot, leaving plenty of time to revive the amendment.

Senate Majority Leader Larry Pogemiller, DFL-Minneapolis, said he's not giving up on his bill for the year.

"It's just a bump in the road," he said after the committee's 7-5 vote against it.

Added John Schroers of the Minnesota Outdoor Heritage Alliance: "I don't think the fat lady has sung yet."

The committee actually had eight opponents because Committee Chairman Tom Bakk, DFL-Cook, didn't vote. He said later he wouldn't have supported the bill.

House Transportation Finance Committee approval
January 24, 2007 (HF 106)

The House Transportation Finance Committee approved the bill on a divided voice vote. In fact, the committee action took less than an hour. Supporters of the measure renewed their call to pass a law that would require everyone in a car to wear a seat belt. The bill would also allow police officers to solely pull over motorists for not wearing a seat belt. Current law allows police officers to ticket motorists but only after they were pulled over for another offense.
